PanFuBanGui[2022]No.1NoticeofOfficeofPanyuDistrictPeople’sGovernmentofGuangzhouonIssuingSupportMeasuresofPanyuDistricttoPromoteVentureCapitalInvestmentIndustryAgglomerationandDevelopmentinWanboBusinessDistrictAlltowngovernments,streetofficesandorgansdirectlyunderPanyuDistrictPeople’sGovernment:SupportingMeasuresforPanyuDistricttoPromoteVentureCapitalInvestmentIndustryAgglomerationandDevelopmentinWanboBusinessDistricthavebeenreviewedandagreedinprinciplebytheexecutivemeetingofPanyuDistrictGovernment,andareherebyissuedtoyouforyourcomplianceandimplementation.ProblemsencounteredduringimplementationshallbedirectlyreportedtoPanyuDistrictBureauofDevelopmentandReform.OfficeofPanyuDistrictPeople’sGovernmentofGuangzhouJanuary29,2022SupportMeasuresofPanyuDistricttoPromoteVentureCapitalInvestmentIndustryAgglomerationandDevelopmentinWanboBusinessDistrictArticle1Inordertofurthergiveplaytotheleadingandinnovativeroleoffinance,vigorouslydevelopnewfinancewithPanyucharacteristic,attractallkindsofventureinvestmentinstitutionstogatherinWanboBusinessDistrict,andcreateahigh-qualitydevelopmentclusterofventureinvestmentindustry,accordingtoOpinionsoftheStateCouncilonFurtherImprovingEmploymentandEntrepreneurshipintheNewSituation(GuoFa[2015]No.23),SeveralOpinionsoftheStateCouncilonPromotingSustainableandHealthyDevelopmentofVentureCapitalInvestment(GuoFa[2016]No.53),OpinionsoftheStateCouncilonPromotingHigh-qualityDevelopmentofInnovationandEntrepreneurshipandCreatinganUpgradedVersionof“InnovationandEntrepreneurship”(GuoFa[2018]No.32),RegulationsofGuangzhouonScienceandTechnologyInnovation,NoticeofGuangzhouMunicipalPeople’sGovernmentonIssuingSeveralProvisionsonSupportingtheConstructionofGuangzhouRegionalFinancialCenter(SuiFuGui[2019]No.1)NoticeoftheGeneralOfficeofGuangzhouMunicipalPeople’sGovernmentonIssuingAdministrativeMeasuresforStandardizedDevelopmentofGuangzhouVentureInvestmentMarket(SuiFuBanGui[2020]No.21)andsoon,theseMeasuresareherebyformulatedinlightoftherealitiesofPanyuDistrict.Article2The“ventureinvestmentinstitutions”hereinmainlyincludeinvestmentfundenterprises(equityinvestmententerprisesandventurecapitalinvestmententerprises),aswellasinvestmentfundmanagemententerprises(equityinvestmentmanagemententerprises,venturecapitalinvestmentmanagemententerprisesandprivatesecuritiesinvestmentmanagemententerprises).Allinvestmentfundenterprisesandinvestmentfundmanagemententerprisesthatcomplywithnationallaws,regulationsandpoliciescanberegisteredinWanboBusinessDistrictwithoutindustryaccessapproval.Investmentfundenterprisesandinvestmentfundmanagemententerprisesshall,aftergoingthroughcommercialregistrationprocedures,complywiththerelevantnationalprovisionstocompletetheregistrationofprivatefundmanagersandthefilingofprivatefundproducts,filingofventurecapitalinvestmententerprises,creditinformationregistrationofgovernment-fundedindustrialinvestmentfundsandotherprocedures.Article3TheseMeasuresareapplicabletoinvestmentfundenterprisesandtheirinvestmentfundmanagemententerprisesinWanboBusinessDistrict.Theaboveinvestmentfundenterprisesandtheirinvestmentfundmanagemententerprisesshallalsomeetthefollowingconditions:(1)Complyingwithnationallaws,regulationsandpolicies,havinggonethroughvariouscorrespondingfilingandregistration,andhavingobtainedvariousfinancialbusinessqualificationsapprovedandissuedbynationalfinancialregulatoryorgansorauthorizedmanagementorgans.(2)Havingasoundfinancialsystemandimplementingindependentaccounting.(3)Operatingingoodfaithinaccordancewithlawsandregulations,andengaginginnoillegalandcriminalactssuchasillegalfund-raising;theenterpriseanditslegalrepresentativeandexecutivepartners(includingtheappointedrepresentatives)havingnobadcredit,tax-relatedpenaltiesandcriminalrecords.TheseMeasuresmayapplytoinvestmentfundenterprisesandtheirinvestmentfundmanagemententerprisesinkeydevelopmentplatformsandkeyparksinPanyuDistrictiftheymeettheconditionsherein.Article4InvestmentfundmanagemententerprisesareencouragedtosetupofficesinWanboBusinessDistrict.InvestmentfundmanagemententerprisesworkinginWanboBusinessDistrictwillbegivensubsidiesfortherentalanddecorationofofficespace(excludingancillaryandsupportingrooms).Suchsubsidiesshall,basedontheenterprise’sactualmanagementscaleandrentedarea,beprovidedinsuchawaythattheactualrental(excludingmanagementfeesandothermiscellaneousfees)willbefullyexemptedforthefirstthreeyearsandhalvedforthenexttwoyears;however,therentalperunitareashallnotexceedtwicethereferenceofficespacepriceofthepreviousyearaspublishedbyGuangzhouMunicipalOfficeofRealEstateLeasingManagement.TheactualmanagementscaleofinvestmentfundmanagemententerprisesiscalculatedbasedonthetotalfundsthatareraisedbythemandareactuallymanagedinWanboBusinessDistrict,whereforevery100millionyuan(RMBorequivalentforeigncurrency,thesamebelow)ofsuchfunds,theenterpriseswillbegivenarentalsubsidycoveringupto100squaremeters,andthemaximumsubsidy-coveredareashallnotexceed1,000squaremeters;theone-offdecorationsubsidyshallbegivenbasedontheactualdecorationstandard,butsuchsubsidyshallnotexceed1,000yuanpersquaremeter,andtheareacoveredbysuchfitting-upsubsidyshallbesubjecttotheactualrentalsubsidy-coveredarea.Theinvestmentfundmanagemententerprise,whenrentingofficespace,shallgothroughtheregistrationandfilingofhouserentinginaccordancewithGuangzhouHousingLeaseManagementRegulations.Article5Investmentfundenterprisesareencouragedtoinvestinunlistedscienceandtechnologyenterprises(includinghigh-techenterprises,thesamebelow)inPanyuDistricttohelpthemrelievefinancingdifficulties.IfaninvestmentfundenterprisehasinvestedinanunlistedscienceandtechnologyenterpriseinPanyuDistrictforover2years,suchinvestmentfundenterprisewillberewardedwithupto1millionyuanat2%oftheactualpaid-ininvestment,andthemaximumrewardforeachinvestmentfundenterpriseshallnotexceed5millionyuanperyear.Incaseofentrustedinvestmentmanagement,therewardwillbegiventotheentrustedenterprise.Article6Fortalentsofinvestmentfundmanagemententerprisesqualifiedashigh-leveltalentsofPanyuDistrict,relevantorgansshallprovidethemconvenientservicesintermsofmedicalandhealthcare,talentresidencepermit,theirchildren’senrollmentintoschool,housingsecurityandsoonaccordingtothehigh-leveltalentservicepolicy.Article7Investmentfundenterprisesandinvestmentfundmanagemententerprisescanenjoyrelevantnational,provincialandmunicipalpolicieswheneverapplicable.However,whereanenterpriseiseligibleformultipledistrictincentives,theenterprisecanonlychooseonetoenjoy,andsuchchoicecannotbechangedonceselected.Article8PanyuDistrictBureauofDevelopmentandReformshalltaketheleadindisclosingtheapplicationguidelinesoftheseMeasurestothepublic.Eligibleenterprisescanmakeanapplicationforthesupportfund.PanyuDistrictBureauofDevelopmentandReformwillreviewtheenterpriseapplicationmaterialstogetherwithrelevantdepartments,applytotheDistrictFinanceBureauforallocatingsupportfundsaccordingtotheprescribedprocedures,andreporttothedistrictgovernmentregularly.Article9ThesupportfundsundertheseMeasuresaresubjecttosupervisionoftheauditauthority;theyshallbeincludedintheannualorganbudgetbyPanyuDistrictBureauofDevelopmentandReform,andPanyuDistrictFinanceBureaushallmakeoverallarrangementsintheannualfinancialbudget.Allrelevantorgansshallactivelyoptimizethedevelopmentenvironmentofthedistrict,providehigh-qualityservicesandrecommendhigh-qualityprojectsintheregion.Article10Investmentfundenterprisesandinvestmentfundmanagemententerprisesshallberesponsiblefortheauthenticityoftheirapplicationdocuments.Forenterprisesthatresorttofraudanddefraudsupportingfunds,thealreadyallocatedsupportingfundsshallberecovered,andsuchenterprisesshallbedealtwithaccordingtorelevantregulationsandwillnotbeabletoapplyforotherfinancialfundsupport.Additionally,theyshallbeincludedinthelistofkeymonitoringenterprisesofGuangzhouFinancialRiskMonitoringandControlCenter,andwillbepunishedaccordingtolawfortheirdishonestconduct.Ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedaccordingtolaw.Article11TheseMeasuresshallenterintoforceasofthedateofissuance,andshallremainvalidfor5years.。
