Totownshipgovernments,sub-districtoffices,districtgovernmentdepartmentsanddirectlyaffiliatedinstitutions:TheDetailedRulesforImplementationtoDeepenUrbanRenewalandPromoteHigh-qualityDevelopmentinZengchengDistricthasbeenapprovedbytheDistrictPartyCommitteeandtheDistrictGovernmentandisherebyprintedanddistributedforimplementation.Foranyproblemsencounteredintheimplementationprocess,pleasereportdirectlytoMunicipalPlanningandNaturalResourcesBureauofZengchengBranch.GuangzhouZengchengDistrictPeople'sgovernmentOfficeOctober20,2021DetailedRulesforImplementationtoDeepenUrbanRenewalandPromoteHigh-QualityDevelopmentinZengchengDistrictInordertofurtherimprovethesupportingmeasuresforurbanrenewalandpromotehigh-qualitydevelopmentwithhigh-qualityurbanrenewal,theseDetailedRulesareformulatedinaccordancewiththeImplementationOpinionsonDeepeningUrbanRenewalandPromotingHigh-qualityDevelopment(SuiZi[2020]No.10)andotherdocuments,combinedwiththeactualsituationofZengchengDistrict.1.Strengthenthereviewoftheimplementationplanoftheoldvillagerenovationproject(1)Reviewtheeffectivenessoftheoldvillagetargetmapdatabase.ThemainbodyoftransformationimplementationshouldentrustatechnicalunitwithGradeAsurveyingandmappingqualificationtochecktheeffectivenessoftheplottingdatabaseof"threeold"transformationofoldvillage,oldfactoryandoldtownbeforetheprojectimplementationplanisreviewed.Thereviewreportservesasthebasisforlandpreparationoftheimplementationplan.(2)Makecleardemolitionandreclamationauditprocedures.Iftheoldvillagerenovationprojectinvolvesdemolitionandreclamation,themainbodyofrenovationimplementationshallpreparethedemolitionandreclamationplan,whichshallbeusedasthebasisforlandpreparationoftheimplementationplanafterbeingapprovedbyexpertsorganizedbythePlanningandNaturalResourcesDepartmentofdistrict.Inprinciple,thescaleandindexturnoverofnewconstructionlandarenotarrangedinthearea,andtheexistingconstructionlandshouldgiveprioritytotheconstructionandresettlementofdistrictandpublicservicefacilities.(3)Strictlycontrolthescaleofnewconstructionland.Inprinciple,thescaleofnewconstructionlandshallnotbearrangedfortheoldvillagereconstructionprojectexceptforthe"threeplaces",thelandingofthereservedlandindexandthesupplementaryrecordingofthe"threeold"reconstructionmap.AfterbeingexaminedandapprovedbythePlanningandNaturalResourcesDepartmentofdistrict,therevisedplanoftherelevantlandusemasterplanwillserveasthebasisforimplementingthelandpreparationoftheplan.Inthelaterimplementationprocess,theplanningandnaturalresourcesdepartmentsofdistrictimplementedtherevisionplaninstagesaccordingtotheconstructiontimesequencethroughthepreparationoflandandspaceplanning.(4)Ensurethesafetyofsoilenvironment.Ifitisnecessarytocarryoutsoilenvironmentalinvestigationandassessmentaccordingtotherequirementsofrelevantdocumentsonsoilpollutionpreventionandcontrolmanagement,themainbodyoftransformationimplementationshallprovidealetterofcommitmentincludingcompletingthereviewofinvestigationandassessmentreportbeforelandsupply,andcompletingcontentsuchascontrolandrestorationinstrictaccordancewiththerequirementsbeforelandsupplyifcontaminatedlandisinvolved,andthentheapprovedimplementationplancanbegiven.(5)Adjustthelistingtimeofbidding(investmentpromotion).Theannouncementtimefortheintroductionofcooperativeenterprisesthroughpublicbiddingforoldvillagereconstructionprojectsandtheintroductionofcooperativeenterprisesthroughinvestmentshallbenolessthan30naturaldaysrespectively.2.Improvetheimplementationmechanismoftheoldvillagereconstructionproject(6)Strengthentheinvestigationandmanagementofbasicdata.DistrictPlanningandNaturalResourcesDepartmentandtownship(sub-district)governmentshouldstrengthenthemanagementofbasicdatainvestigation,furtheroptimizetheinvestigationmechanism,andmakeagoodconnectionbetweenthebasicdataresultsofoldvillagereconstructionandtheregistrationresultsof"integrationofrealestateandland".Villagecollectiveeconomicorganizationsorcooperative(intentional)enterprisesthatinterferewithbasicdatainvestigationandresorttodeceitshallcancelthequalificationofoldvillagereconstruction,andseriouslyinvestigatetherelevantmainresponsibilities.(7)Establishtheoldvillagecomprehensivetransformationmarketareapriceevaluationsystem.ThePlanningandNaturalResourcesDepartmentofdistrictorganizesthepriceevaluationofareasinthecomprehensiverenovationmarketofoldvillagesinthedistrict,andtherelevantresultsareregularlyupdatedandpublishedeveryyear.Theimplementationplanoftheoldvillagereconstructionprojecttakesthepublishedareaprice(technicallyrevisedaccordingtothefloorarearatio,etc.)astheaccountingbasisforthefinancingarea.Iftheareapriceofresidentialareasinvillageislowerthantheaveragepriceofthewholedistrict,inprinciple,theapplicationforrenovationofoldvillageswillnotbeaccepted(exceptforoldvillagesthathavebeenincludedindistrictOldVillageRenovationProjectDatabaseandkeyareasledbythegovernment).(8)Makeclearupfrontcostsincludedinthetransformationcoststandard.Theevaluationfeeoffinancinglandpriceforcalculatingfinancingareawithareapriceis300,000yuan/project,thecompensationformovingis4,000yuan/countablebuilding,andthemigrationfeesuchastelephoneandtelevisionisincludedintherenovationcostaccordingto550yuan/countablebuilding;Basicdatasurveyfees,landsurveyanddemarcationfees,anddistrictplanningschemepreparationfees(includingregulatorydetailedplanningschemepreparationfees)areincludedintherenovationcostaccordingtothegovernmentbiddingcontractandtheactualpaymentamount,butshallnotexceedthecostaccountingstandardforcomprehensiverenovationofoldvillagesinGuangzhou.(9)Strengthenindustrialintroduction.Thewholeregionisdividedintothreeindustrialcirclesaccordingtokeyfunctionalareas,landvalueandotherfactors.Inprinciple,theindustrialconstructionamountofoldvillagereconstructionprojectsinthefirst,secondandthirdcirclesisnotlessthan25%,15%and10%ofthetotalprojectconstructionamountrespectively,ortheindustrialconstructionamountoffinancingplotsisnotlessthan30%,20%and15%ofthetotalfinancingconstructionamountrespectively.Theoldvillagereconstructionprojectshouldimprovetheindustrialentrythreshold,improvethequalityofimportedindustries,andstrengthenthesupervisionofindustrialintroduction.Specifically,thePlanningandNaturalResourcesDepartmentofdistrictshouldformulaterelevantmanagementmeasureswiththecompetentindustrialdepartmentofdistrict.(10)Giveprioritytotheconstructionofgovernmenthousing.Thegovernmenthousesallocatedfortheoldvillagereconstructionprojectshouldbegivenprioritytocentralizedconstruction.Thehousingandurban-ruralconstructiondepartmentsoftownship(sub-district)anddistrict,andtheplanningandnaturalresourcesdepartmentsofdistrictshouldspecifythearea,locationanduseofthehousesinthedetailedplanningschemeoftheprojectaccordingtothegovernment'suseneeds.Withtheconsentofthedistrictgovernment,ifthegovernmenthousingisbuiltbythemainbodyresponsibleforthetransformation,thehousingindexcanbedeductedfromtheconstructionandinstallationexpensesaccordingtothemarketevaluationprice.(11)Standardizethereservedlandintotheoldvillagereconstructionprocedures.Iftheoldvillagerenovationprojectcannotachievethebalanceoffundsduetotherestrictionoflanduseandplanningconditions,otherlandwithinthescopeofownershipofthevillagethatconformstotheoverallplanningoflandandspacecanbeincludedinthescopeofrenovation,andthedebtindexofreservedlandcanbededucted.Iftheindexisinsufficient,theindexofreservedlandcanbeappliedforadvance.Involvingtheadvancereservelandindex,itisnecessarytosignthelandacquisitionagreementofthemainplotandreportittothedistrictgovernment,cityplanningandnaturalresourcesdepartmentforapprovalinaccordancewithrelevantregulations,andthentheapprovedimplementationplancanbegiven.(12)Makeclearsupportingrequirementsforeducationalfacilities.Iftheoldvillagereconstructionprojectissmallinscaleandeducationalfacilitiesareallocatedaccordingtotheplannedpopulationtoproduceschoolswithsmallscale,poorconditionsandlowquality,theeducationalfacilitiescanbecoordinatedregionallywiththeconsentoftheeducationdepartmentsoftownship(sub-district)anddistrict.Thepercapitaconstructionareaofeducationalfacilitiesshallbeallocatedby25-50%accordingtothestandardsofGuangzhouUrbanandRuralPlanningTechnicalRegulations;Inprinciple,theaveragelandareaperstudentisallocatedaccordingtothestandardofareasoutsidethecentralcityintheTechnicalRegulationsonUrbanandRuralPlanningofGuangzhou.AfterbeingfullydemonstratedandreportedtotheEducationDepartmentofdistrictforapproval,itcanbeallocatedaccordingtothemedianvalueofnotlessthanthedowntownareaandareasoutsidethedowntownarea.(13)Protectthevillagers'righttoknowandvote.Intheprocessofsubmittingtheimplementationplanforapprovalandvoting,Demolitioncompensationandresettlementstandards(individualandcollective),Collectiveconstructionlandistransferredtostate-ownedconstructionland,othernon-constructionlandisexpropriatedintothescopeoftransformation(deductionofretainedlanddebtindex,advanceretainedlandindex),conversionofretainedlandindexintocollectivepropertystandard,resettlementofdistrictsiteselectionandlandsupplyobjects,generallayoutdesigndrawingsandothermattersinvolvingvillagers'vitalinterestsshouldbeexplainedtovillagersindetail.Asanindependentmatter,itwillbevotedbytherepresentativemeetingofmembersofcollectiveeconomicorganizationsinvillageandformasummary,andtherelevantcontentandvotingwillbepublicizedfor5naturaldays.3.Strengthentheimplementationandmanagementofoldvillagereconstructionprojects(14)Strengthenthemanagementofprojectsigningandapproval.AftertheimplementationplanwasreviewedandapprovedbythedistrictUrbanRenewalLeadingGroupMeeting,township(Sub-district)instructedvillagecollectiveeconomicorganizationsandtransformationimplementerstosignthedemolitioncompensationandresettlementagreement.Theimplementationplancanonlybeapprovedforprojectswithanoverallsigningrateofmorethan50%.(15)Promotethedemolitionandconstructionofkeyprojects.Aftertheoldvillagereconstructionprojectisintroducedintothecooperativeintentionenterprise,beforetheimplementationplanisapprovedandtakeseffect,ifitinvolvestheconstructionoflarge-scalemunicipalsupportingfacilities,publicservicefacilitiesandkeyindustrialprojects,thecooperative(intention)enterpriseshallfirstassistthetownship(sub-district)tocarryoutthedemolitionconstructionandberesponsiblefortherelevantexpenses,whichshallbeincludedinthereconstructioncostinlinewiththeurbanrenewalpolicy.(16)Strengthenthepre-salecontroloffinancingarea.Aftertheimplementationplancomesintoeffectandtheresettlementdistrictandpublicservicefacilitiesstartconstruction,thefinancingdistrictcanbeconstructedsimultaneously.Theconstructionprogressofresettlementdistrictmustbefasterthanthatoffinancingdistrict.Onthepremiseofmeetingtherequirementsofrelevantdocumentsandensuringthesuccessfulcompletionoftheprojectresettlementdistrictandpublicservicefacilities,thepre-saleofsomefinancedcommercialhousesisallowed,andthePlanningandNaturalResourcesDepartmentofdistricttakestheleadinformulatingrelevantoperationalregulations.4.Promotethetransformationofoldfactoriesintopieces(17)Reviewtheeffectivenessoftheoldfactorybuildingprojecttargetmapdatabase.DistrictplanningandnaturalresourcesdepartmentsshouldentrusttechnicalunitswithGradeAsurveyingandmappingqualificationstoreviewtheeffectivenessofthe"threeold"reconstructionmapsbeforetheapprovaloftheimplementationplan.Theeffectivepartafterreviewcanbeappliedtotheurbanrenewalpolicy.Afterreview,ifthepartoftheplottingdatabasethatdoesnotmeetthelatestwarehousingconditionsistransformedaccordingtothegovernment'spurchasingandstoragemethods,thecompensationcanbecalculatedwithreferenceto80%ofthecompensationstandardfortheeffectiveplottingdatabase,butthetotalcompensationshallnotexceed45%ofthetransactionpriceofpublictransfer.(18)Promotethetransformationofoldfactoriesinkeyareas.LocatedalongthemainurbanroadssuchasGuangshanHighwayandXinchengAvenueandthemainurbanareasofLichengandXintang,InadditiontothecompensationaccordingtoArticle(17),thecompensationforthepartwithoutplottingcanbecalculatedwithreferenceto80%ofthecompensationstandardforeffectiveplotting,butthetotalcompensationshallnotexceed45%ofthetransactionpriceofpublictransfer.Incaseofcontiguousreconstructionofmultipleadjacentplots,eachownershallobtaincompensationaccordingtothepriorityorderofthevalidplottingdatabasebuildingpart,theplottingdatabasebuildingpartthatdoesnotmeetthelatestwarehousingconditions,andthenon-plottingdatabasebuildingpart.(19)Facilitatetheconstructionofaffordablehousing.LocatedinthekeyareaslistedinArticle(18),the"industrialtoresidential"projectshallbeallocatedwithaffordablehousingfreeofchargeaccordingto5%oftheresidentialconstructionareaoftheproject.(20)Delineatethenegativelistofoldfactoryrenovation.Iftheoldfactorylandbelongstothefollowingcircumstances,theurbanrenewalpolicyshallnotbeapplied:a.Theplotswithintheindustrialblocksdonotmeettheregulationsonthemanagementofindustrialblocksaftertransformation;b.Plotsthatdonotmeetthelatestwarehousingconditionsfortheconstructionofthe"threeold"transformationmaparetransformedbythemselvesaccordingtobusinesspurposes;c.Thelandthathasbeenidentifiedasidlehasnotbeendisposedof,orhasbeendisposedofbuthasnotimplementedthedisposalrequirements;d.ThelanduserighthasbeenobtainedforthefirsttimeafterDecember31,2009(exceptforplotswithperfectlanduseproceduresaccordingtotheurbanrenewalpolicy).5.Exploreahigh-qualityurbanrenewalmodel(21)Supportstate-ownedenterprisestoparticipateinthetransformation.Encouragestate-ownedenterprisesinthedistricttoparticipateinurbanrenewalaccordingtolawthroughcapitaloperationandpreliminaryservices,andfocusonexploringthepreliminaryworksuchasthepreparationoftheimplementationplanoftheoldvillagereconstructionproject(includingthecompensationandresettlementstandardsfordemolition)ledbystate-ownedenterprisesinthedistrict,andthenintroducemarketplayerstocarryoutdemolitionandconstructionbymeansofpubliclistingandbidding.Aftertheprojectispubliclylistedandsold,thereasonableexpensesincurredbythestate-ownedenterprisesintheregionwillbereturned,andthepremiumgeneratedbypublicbiddingcanbespeciallysupportedforitsdevelopment.(22)Promotethepilotoldvillagetransformation"combinationofstorageandreform".Oldvillagereconstructionprojectsaroundurbanmainroadsandimportantdevelopmentplatformsstrengthenthe"combinationofstorageandreform",andthegovernmentleadsthescientificdelineationofthescopeofoldvillagereconstructionandlandpurchasingandstorage,andsimultaneouslycarriesoutthereconstructionandpurchasingandstoragework.Thereservedlandgeneratedbypurchasingandstoringlandwillbegivenprioritytobalancetheintensityofrenovationanddevelopmentofoldvillages.The"combinationofstorageandreform"projectgivesvillagecollectivepropertyrewardsaccordingtothesquaremeterstandardof10permuofgovernmentreserveland,andtheconstructioncostisself-raisedbyvillagecollectiveeconomicorganizations,whichisnotincludedintherenovationcost.(23)Explorethegovernment-ledmodelofoldcityreconstruction.Ifmorethan90%(inclusive)ofthepropertyownersintheoldcityreconstructionareaagreetothereconstruction,Afterthegovernmenttakestheleadinorganizingthebasicdatainvestigation,compilingtheimplementationplan(includingthecompensationandresettlementstandardsfordemolition)anddeterminingthedevelopmentandconstructionconditions,thedemolitiontaskandtherighttousethelandtobereconstructedwillbepubliclylistedtodeterminethemainbodyofreconstruction,andthehousedemolitionwillbeimplementedwhenthecompensationandresettlementagreementfordemolitionreachesmorethan90%(inclusive),andthetransfercontractwillbesignedwhenthecontractreaches100%.Thecontiguousreconstructionprojectoftheoldcitycanbeimplementedflexiblyanddynamicallybystageswithreferencetotheoldvillageproject.(24)Facilitatetheimplementationofplotratiobalanceindifferentplaces.Iftheaveragenetfloorarearatioofresidential(includingcommercialandresidential)landintheoldvillagereconstructionprojectexceeds4.5,theexcessshouldbebalancedindifferentplacesbymeansoftransferoffinancingareadevelopmentrightsandinterests.Themainbodyoftransformationimplementationcanundertakethecorrespondingfinancingareadevelopmentandtransferrightsandinterestsaccordingtotheprincipleofequivalentvalue(calculatedbyareapriceinthecomprehensivetransformationmarketofoldvillages)bypubliclycompetingforthebusinesslandreservedforthetransformationofoldvillagesindifferentplaces.6.Others(25)Strengthensupervisionandmanagement.Township(Sub-district)andrelevantfunctionaldepartmentsshouldstrengthenthesupervisionofurbanrenewal,focusingontheintroductionofcooperativeenterprisesinoldvillagereconstruction,industryintroduction,schemeapproval,implementationofsupervisionandotheraspectstostrengthenthesystemconstruction,andeffectivelypreventtheriskofcleangovernment.Therelevantdepartmentsshallbeseriouslyaccountableandresolutelyinvestigateanddealwithviolationsofdisciplineanddisciplineintheprocessoftransformation;Ifitconstitutesaviolationofthelaw,therelevantsubjectsshallbeinvestigatedforresponsibilityaccordingtolawtoensurethattheurbanrenewalworkiscarriedoutina"transparent,standardized,efficientandclear"way.(26)TheDetailedRulesshallbeimplementedasofthedateofissuanceandshallbevalidfor3years.BeforetheimplementationoftheseRules,theimplementationplanoftheurbanrenewalprojecthasbeenreviewedandapprovedbythedistrictUrbanRenewalLeadingGroupMeeting,andshallbeimplementedinaccordancewiththereviewedandapprovedimplementationplan.微信扫一扫,分享到朋友圈。
